OC Oerlikon Management AG, Pfäffikon, Switzerland and its subsidiaries (“Oerlikon”) are committed to safeguarding your privacy. This Privacy Policy explains to you, external business contacts (e.g. clients, suppliers, partners, website users..), how Oerlikon processes your personal data collected either through this website (www.oerlikon.com) or during your business relationship with us. By personal data, we mean any information that may identify directly or indirectly an individual.

Oerlikon Balzers Coating India Private Limited (hereafter “Oerlikon”, “we” or “us”) is committed to safeguarding your privacy in line with the Digital Personal Data Protection Act, 2023.

This Privacy Policy explains to you, external business contacts (clients, prospects, suppliers, website users), why and how Oerlikon uses your Personal Data collected either through this website or during your business relationship with us.

By Personal Data, we mean any information that may identify directly or indirectly an individual.

For more clarity, this Privacy Policy is divided into 3 sections for respectively:
Website users (1st section); Clients and Prospects (2nd section) and Suppliers (3rd section).

1. How and why Oerlikon collects and uses Personal Data about website users?

Oerlikon collects:

  • Personal Data that website users voluntarily provide to us through our Contact forms on this website. Such Personal Data:
    • is used for a legitimate use: responding to the request/message of the website user;
    • includes contact information (such as first and last names, professional email address and phone number, company’s name, industry, brand and country) and your request/ message to us
    • is kept the time necessary to answer your message and is then either deleted or recorded in our systems (if there is a legal need to keep it based on Indian laws or if necessary to manage the business relationship with you as expected or requested by you).
  • information from website users’ computer or electronic device when they navigate this website. This information is collected through cookies and equivalent tracking technologies. Website users can i) accept or reject the use of cookies (and equivalent tracking technologies) on our website through our Cookie Banner and ii) learn more in our Cookie Policy about how and why we use cookies (and equivalent tracking technologies) and how to withdraw consent for the use of such cookies (see section 3 “Deactivate Cookies” of the Cookie Policy).

2. How and why Oerlikon collects and uses Personal Data about prospects and clients?

Oerlikon collects and records in its systems only Personal Data about business contacts as clients and prospects who requested to be part of our business contacts, provided voluntarily their contact details to us for such purpose or agreed to be contacted by us.

We collect very limited Personal Data about our prospects and clients (i.e. name, surname and professional contact details) to manage our business relationship with them and their company as expected by them.

More precisely, we use it for the following legitimate uses: centralize such Personal data in our customer relationship management systems to manage our business relationship with them and their company and respond to their business requests and needs. We might use it to protect Oerlikon’s rights and interests in case of litigation or fulfil a legal obligation to disclose it upon request from Indian government, public authorities, courts. We will not use it for direct marketing purposes without your prior consent.

Personal Data will not be kept longer that what is necessary to the above business purposes and what is legally required. Your professional contact details will be deleted/deactivated 3 years maximum after the end of our contractual relationship if you are a client. If you are a prospective client, we will promptly delete your Personal Data upon request or after one month if you remain completely silent since our first communication to you and have not provided consent to receive commercial information from us. Every year we will in addition make a cleaning of our systems to ensure that no inactive prospective client remains in our customer relationship management systems.

If you would like to receive invites to our events and interesting information about Oerlikon’s services and products, you can either click on the red button in the Privacy Notice sent to you by email as soon you are recorded as new contact in our CRM (Customer Relationship Management system), mention the same on the contact form on our website or inform our Sales team members by email. You will be able to withdraw such consent and unsubscribe to our commercial messages by clicking on the “unsubscribe” link present at the end of all our commercial emails or by contacting your Sales team contact.

You have rights on your personal data, the right to request a summary of the personal data we have about you and the processing activities undertaken by us with respect to such personal data, the right to correction (where incorrect /outdated) or deletion (we will delete upon your request except if retention is necessary for the legal purposes mentioned in this privacy notice), the right to nominate another person to exercise your rights in case of death or incapacity, and to express any concern or grievance in relation with the use of your personal data. Please contact your Oerlikon Sales contact, if you want to update, correct your contact details. To exert any other right or raise a grievance, please contact our Privacy Compliance coordinator at Privacy.India@oerlikon.com. We will respond as soon as possible and in any case within one month maximum from receipt of your request. You can complain to the India Data Protection Board if you believe that your Personal Data were used in violation of the Digital Personal Data Protection Act, 2023.

3. How and why Oerlikon collects and uses Personal Data about suppliers?

Oerlikon collects personal data about its suppliers (internal contacts) only under the below circumstances and conditions:

  • the supplier (internal contact) voluntarily provided his contact details to us, notably through the contact form on this website, to present its services/products and discuss business opportunities. In such case, we use the same for these expected purposes;
  • the supplier company’s official website has publicly displayed the contact details of a relevant salesperson/team: in such case, we use the same to contact the supplier to obtain a description of its products/services, prices and discuss any business matter as expected;
  • if we ask suppliers to provide mandatory information about themselves and their company notably on an Oerlikon dedicated platform for legal due diligence purposes, we collect consent.

Personal data we collect about suppliers (internal contacts) are limited to name, surname, business contact details.

We use suppliers’ Personal Data solely for discussing their products/services, offers, prices and for contractual and legal management purposes, as defending our rights before courts and competent authorities. We keep those Personal Data confidential.

We delete generally suppliers’ contact details 3 years after the end of the contractual relationship except if there is a new negotiation or litigation in between.

In the case where we would have collected supplier’s (internal contact ) Personal Data based on consent (i.e. in the case we would use an online platform in which you entered mandatory fields), such supplier can exert the following rights by contacting our Compliance manager at Privacy.India@oerlikon.com.

  • Supplier (internal contact) has the right to:
    • know whether Oerlikon holds Personal Data about him/her and for which purpose
    • get a copy or summary of Personal Data we hold about him/her
    • request the correction or deletion of his/her Personal Data if incorrect or outdated
    • withdraw his/her consent: Personal Data will not be used anymore and will be deleted (except if Oerlikon is legally required to keep it to defend its rights in case of lawsuit before an Indian court/regulator).
    • complain to Oerlikon if he/she considers that his/her Personal Data have been misused
    • complain to the Indian Data Protection Board If he/she is not satisfied with Oerlikon’s answer and considers that his/her Personal Data have been used in violation of the Indian Digital Personal Data Protection Act, 2023.

a. Absolutely necessary cookies

These cookies are needed for you to navigate within our website and for us to operate basic website functions, such as the issuance of anonymous Session IDs for bundling several related queries to a server.

b. Functional cookies

These cookies enable our website to store information the user has already entered (such as user ID, language selection, or the user’s location), in order to offer improved, personalized functions to the user. Functional cookies are also used to enable requested functions such as playing videos.

c. Performance / statistics cookies

These cookies collect information on the usage of this website, including for example the Internet browsers and operating systems used, the number of visits, average duration of visit, and pages called up. Performance cookies serve the purpose of improving the user friendliness of our website and therefore enhancing the user’s experience.

For our analytics, we have replaced Google Analytics by Matomo Analytics, a web analytics service provided by InnoCraft Ltd. Matomo uses visitor config_id – a randomly-seeded, privacy-enabled, time-limited hash of a limited set of the visitor’s settings and attributes. The config_id or config hash is a string calculated for a visitor based on their operating system, browser, browser plugins, IP address and browser language. The information generated about your use of the website will be transferred to Matomo Cloud servers, hosted in Europe. All data is anonymized by Matomo and used only by Oerlikon. We will use Matomo for the purpose of evaluating your use of the website, compiling anonymous reports based on aggregated information on website activity for us and providing other services relating to website activity, such as collecting information about visitors' sessions (e.g. how much time they spend on which pages, which links they click.) and their device (in particular device's IP address (captured and stored only in anonymized form), device screen size, device type, browser information, geographic location (country/region)). This information is not used to identify a single user and will not be joined with other user information by other sources. You can accept or refuse Matomo tracking through the cookie banner, you can then withdraw your consent at any time and refuse the use of Matomo - for this please see the “Deactivate Cookies” section below.

d. Marketing cookies

Marketing cookies are used to track visitors across websites. The intention is to display ads that are relevant and engaging for the individual user.
